Terms of Service.

Arachnida Apps is built and run by one person, Alexander Rodriguez (theWebCrawler). “I”, “me” and “Arachnida Apps” below mean me; “the Service” means this site, your Arachnida account, and the apps that use it, including Portia.

By using the Service you agree to these Terms and to the Privacy Policy. Some apps have terms of their own for what is particular to them, which add to these: Jay and Hexis. Where they conflict for that app, the app's own terms win.

You must be at least 16 years old (and at least the age of digital consent where you live) and able to form a binding contract to have an account. If you are a minor where you live, a parent or legal guardian must review and agree to these Terms for you. AI features, including Portia, are for people 18 and over.

Give accurate information, keep your sign-in details to yourself, and tell me if you think someone else has used your account. An account is for one person; you are responsible for what happens under it.

Use the Service lawfully, and don't:

• harass, threaten, deceive or harm anyone, or share anything illegal or that you have no right to share;
• try to break, overload, probe or get around the Service's security, limits or allowances, including by opening extra accounts;
• scrape, copy or resell the Service, or use it to build a competing one;
• use someone else's account, or pass yourself off as someone you are not.

AI features also have to be used within Anthropic's Usage Policy, since Anthropic's models power them. In particular, don't use Portia to create content that is illegal, sexualises minors, helps make weapons, or targets real people; and don't make a Spiderling that impersonates a real person or tries to convince people it is human.

What you put into the Service, and what Portia makes for you, is yours, to the extent anyone can own it. So that I can run the Service, you give me a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display it, only to provide the Service to you and to the people you choose to share it with. That includes sending it to Anthropic to process AI requests, as the Privacy Policy describes. The licence ends when you delete the content or your account, apart from copies in backups until they are deleted, and anything the law requires me to keep.

You are responsible for what you share. A public link to a chat or silk, and a Spiderling you invite people to, can be opened by anyone who has the link; they may copy what they see, and revoking the link can't undo that. People who use your Spiderling can't see its instructions, but they can talk with it.

Keep your own copies of anything important. The Service is run by one person and can lose data, however carefully it is looked after.

Portia's answers are generated by an AI model. They can be wrong, out of date, incomplete or made up, even when they sound sure. They are not professional advice, whether medical, legal, financial, psychological or otherwise, including when Portia is reading your budget in Jay or your personality results in Hexis. Check anything that matters before you rely on it; you are responsible for how you use what it gives you.

Silks (the pages, apps and images Portia makes) are run in a sealed-off space and may not work as intended. Spiderlings are written by the people who make them, not by me.

AI features are free during the beta, with an allowance that depends on your plan. I can change the allowances, or change or end the beta. If paid plans arrive, you will have to subscribe yourself; you will never be moved onto a paid plan or charged automatically.

Paid plans are sold through Lemon Squeezy, the seller of record, whose terms cover the payment itself, including billing, tax and refunds. A subscription renews until you cancel it. Cancel any subscription before you delete your account.

You may read, download and share what is published on this site, such as the blog, for personal, non-commercial use; anything more needs my permission. It may contain mistakes and isn't guaranteed to be accurate, complete or current.

I don't control the other sites this one links to and am not responsible for them; a link is not an endorsement. The Arachnida Apps name, logos, software and design are mine and protected by intellectual-property law; these Terms give you no rights to them beyond using the Service as intended.

You can stop using the Service and delete your account at any time from your account page. I may suspend or close an account, with or without notice, if I reasonably believe it has broken these Terms or the law, or to protect the Service or the people using it. Sections that should outlast an account by their nature (your responsibility for your content, the disclaimers, limits on liability, indemnity and governing law) do.

I may add, change or stop features, or any app, at any time.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. To the fullest extent the law allows, I disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement. I don't promise the Service will be uninterrupted, secure or error-free, that AI output will be accurate, or that defects will be fixed. Some places don't allow some of these exclusions, so some may not apply to you.

TO THE FULLEST EXTENT THE LAW ALLOWS, ARACHNIDA APPS AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR REPUTATION, arising from your use of (or inability to use) the Service, even if advised they were possible. My total liability for all claims about the Service will not exceed the greater of what you paid me for it in the twelve months before the claim, or USD $100.

These limits don't apply where the law forbids them (in some places, for example, to death or personal injury caused by negligence, or to fraud); there they apply as far as the law allows.

To the fullest extent the law allows, you agree to defend, indemnify and hold harmless Arachnida Apps and its operator against claims, losses and costs (including reasonable legal fees) arising from your content, your use of the Service, or your breaking these Terms or the law.

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-laws rules. To the fullest extent the law allows, disputes about the Service or these Terms belong in the state and federal courts located in Louisiana, and you consent to their jurisdiction. Nothing here takes away the protection of mandatory consumer laws where you live, or your right to bring a qualifying claim in a small-claims court.

When I change these Terms, I update the date at the top. For a significant change, I'll ask you to accept the new version when you next sign in. Changes don't apply to the past.
